Motus Institute

1. Introduction

These Terms of Use govern your access to and use of the Motus Institute platform, courses, and services operated by The Tullius Group Pty Ltd (ABN 46 165 338 803).

By enrolling in or accessing any Motus Institute course, you agree to be bound by these Terms.

2. Services Provided

Motus Institute delivers online Pilates education programs via the Thinkific platform, including:

• Pre-recorded course content
• Online learning materials
• Assessments and coursework
• One-on-one mentoring and assessments via Google Meet

All services are provided digitally unless otherwise stated.

3. Eligibility

By enrolling, you confirm that:

• You are at least 18 years of age
• You have the necessary physical and mental capacity to participate in exercise-based education
• You meet any prerequisite requirements outlined in the course enrolment process

4. Certification Disclaimer

Motus Institute courses:

• Provide a Certificate of Completion only
• Do not constitute a nationally recognised qualification under the Australian Qualifications Framework
• Do not automatically qualify you as a nationally accredited Pilates instructor

Students who successfully complete all course requirements may be recognised as “Motus Certified”, which is a private certification issued by Motus Institute and not a government-accredited credential.

5. Payments and Refunds

• All course fees must be paid in full prior to access, unless a payment plan has been agreed
• Payment plans are available at the discretion of Motus Institute
• All sales are final. No refunds will be provided under any circumstances

By enrolling, you acknowledge and agree to this no-refund policy.

6. User Accounts and Access

• Access to course content is granted to the individual purchaser only
• You must not share your login details with any third party
• Motus Institute reserves the right to suspend or terminate access if account sharing is detected

7. Intellectual Property

All content provided by Motus Institute, including:

• Videos
• Programming
• Course materials
• Written content
• Branding and methodology

is the exclusive intellectual property of The Tullius Group Pty Ltd.

You agree that you will not:

• Copy, reproduce, or distribute any course content
• Record, screen capture, or share videos or materials
• Use Motus Institute content to create your own courses or training programs
• Teach, licence, or commercialise Motus content without prior written consent

Any breach of this clause may result in immediate termination and legal action.

8. User Conduct

You agree to:

• Use the platform for personal educational purposes only
• Engage respectfully with instructors and other participants
• Not misuse, disrupt, or attempt to exploit the platform

Motus Institute reserves the right to remove any user who breaches these standards.

9. Health and Medical Disclaimer

Motus Institute provides education in movement and Pilates. It does not provide medical advice.

By participating, you confirm:

• You are medically fit to undertake physical activity
• You will consult a qualified healthcare professional if unsure
• You accept full responsibility for your participation

Motus Institute is not liable for any injury, loss, or damage resulting from participation in course activities.

10. Limitation of Liability

To the maximum extent permitted by law:

• Motus Institute is not liable for any indirect, incidental, or consequential loss
• Liability is limited to the amount paid for the course

11. Account Suspension or Termination

Motus Institute reserves the right to suspend or terminate access without refund if:

• These Terms are breached
• Intellectual property is misused
• Platform misuse or misconduct occurs

12. Privacy

Motus Institute collects and stores participant information in accordance with Australian privacy laws.
Information is used solely for course delivery, communication, and business operations.

13. Marketing and Testimonials

By participating in Motus Institute courses, you agree that:

• Testimonials, feedback, and publicly shared content (e.g. tagged social media posts) may be used for marketing purposes
• No sensitive personal information will be shared without consent

14. Changes to Terms

Motus Institute reserves the right to update these Terms at any time. Continued use of the platform constitutes acceptance of any changes.

15. Governing Law

These Terms are governed by the laws of Queensland, Australia.
